Burger King sued by customers who claim Whopper is smaller than advertised

The Whopper may well be just a little big, at least in real life, claims a new class action lawsuit. Four Burger King customers are suing the chain for its marketing, alleging that the company makes the burger look 35% bigger in its advertising than it actually is.

The plaintiffs in the lawsuit, which was filed on March 28 in the U.S. District Court for the South Florida District, are seeking monetary compensation for anyone who has been “tricked” by Burger King’s advertising, though that the presentation does not indicate any monetary objective. .

“Burger King does not comment on pending or potential litigation,” a Burger King spokesman said in an email to CBS MoneyWatch.

Misleading ads?

The lawsuit alleges misleading business practices, with the record claiming that Burger King began “materially exaggerating the size of its burgers” in ads beginning in 2017. While Whopper’s marketing images may have grown, the “recipe or amount of Beef or the ingredients in Burger King’s Whopper have never changed,” the lawsuit states.

The class action lawsuit alleges that Burger King-size inflation doesn’t stop at Whopper, and notes that ads also exaggerate the size of menu items like Impossible Burger, Big King, and Bacon. Double Cheeseburger, among other items.
